Terms of Service

By accessing pennedforyou.com (the “Service”), you agree to be bound by these Terms of Service. If you disagree with any part of these Terms, you may not use the Service. These Terms constitute a legally binding agreement between you and the operator of this Service.

This Service is currently operated by Cross Ventures LLC, a Georgia limited liability company, or its designated subsidiary. We may transfer operation of this Service to a wholly owned subsidiary entity without notice; such a transfer does not affect your rights under these Terms.

Penned For You creates custom, AI-assisted written and audio content for personal gifting purposes. Depending on the product ordered, this may include:

• Custom poems — original, personalized verses delivered as a digital PDF
• Custom lyrics — song lyrics written to your specifications, delivered as a digital PDF
• Custom songs — original lyrics set to AI-generated music, delivered as a digital audio file

The Process: We use a combination of proprietary workflows and third-party AI models — including Google Gemini, ElevenLabs, and Suno/Kie.ai — to generate written content, vocals, and music.

Delivery: All products are delivered digitally via email. We do not provide physical media. Physical keepsakes (framed prints, lyric art) may be available as separate upsell products fulfilled through third-party partners.

You retain ownership of the original stories, memories, and details you submit. By submitting content, you grant us a limited license to use it solely for fulfilling your order. You agree not to submit content that:

• Constitutes hate speech, defamation, or incitement to violence
• Infringes on the intellectual property of others (e.g., requesting verbatim reproduction of copyrighted lyrics or text)
• Violates the privacy or dignity of a third party without their consent

Creative work involves interpretation, and AI-assisted creation is no different. By using Penned For You, you acknowledge:

• Imperfections: AI may occasionally interpret a story in an unexpected way, mispronounce a name in audio output, or make creative choices that differ from your mental image. These are characteristics of the technology, not product defects.
• Subjectivity: All creative work — whether written by a human or assisted by AI — involves judgment calls about tone, structure, and style. We make every effort to honor your brief, but the result will reflect creative interpretation.
• Safety Filters: Our AI partners have built-in content safety filters. If your prompt triggers these filters, we may be unable to fulfill the order as submitted or may need to modify the content. We will contact you if this occurs.
• Emotional Weight: We understand that many orders are created for significant moments — grief, love, celebration, loss. We take that responsibility seriously and will work with you if the result doesn't honor the occasion appropriately.

We want you to be genuinely happy with what we create. Because every piece is custom-made for you, we do not offer “change of mind” refunds — but we are committed to making it right when something goes wrong.

All Sales Final: Once the content generation process begins, costs are incurred and the sale is final.

Exceptions: Refunds are issued only for technical failures (e.g., a file that cannot be opened and cannot be remedied) or duplicate billing.

European/UK Right of Withdrawal: By completing a purchase, you acknowledge that you are requesting immediate performance of a digital service and thereby waive your 14-day right of withdrawal under EU/UK consumer law once content generation has begun.

Our Service relies on third-party infrastructure providers. We are not liable for service outages, failures, or data incidents caused by these providers:

• Payment processing: Stripe
• Database and storage: Supabase
• Email delivery: Resend
• AI content generation: Google (Gemini), ElevenLabs, Suno/Kie.ai

For U.S. Users: We encourage you to contact us first at hello@pennedforyou.com — most issues can be resolved quickly and informally. If a dispute cannot be resolved informally, you agree to submit it to binding arbitration in the State of Georgia under the rules of the American Arbitration Association. You waive any right to participate in a class-action lawsuit.

For International Users: Nothing in these Terms limits your rights under applicable mandatory consumer protection laws in your jurisdiction (including GDPR, the Australian Consumer Law, or similar frameworks).
